Initial license to operate a place where three or fouradults who are not related to the operator reside and receive care, treatment or services that are above the level of room and board and that may include up to seven hours per week of nursing care per resident.

The Division of Quality Assurance (DQA) has authority for building plan review, including heating, ventilation, and air conditioning (HVAC); fire system construction projects; and non-health care entities attached to health care facilities. Systems not reviewed by DQA are plumbing systems, private on-site waste treatment, elevators, boilers, mechanical refrigeration systems, etc. For contact information on these aspects of building plan review, see the Department of Commerce's website. Contact the municipality where you intend to operate for any local building codes or ordinances that may apply.
